FoodNoise ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your information when you use the FoodNoise mobile application.

Information We Collect

We collect information you provide directly to us when you:

  • Create an account (name, email address, or phone number)

  • Complete the onboarding questionnaire (responses about your goals and experiences)

  • Use in-app tools (journal entries, reflections, intention selections)

  • Sign the pledge (signature image)

  • Set daily intentions and track streaks

  • Use the Don't Smile challenge (camera is used for facial expression detection only — processed on-device, never stored or transmitted)

  • Record a voice note during setup (audio recording stored securely for use in recovery calls)

  • Send messages to and receive responses from Marlo, our AI companion feature (conversations are stored on our servers to maintain context across sessions)

How We Use Your Information

We use your information to:

  • Provide and personalize the FoodNoise app experience

  • Track your progress, streaks, and milestones

  • Send notifications you have opted into (check-ins, streak reminders)

  • Improve the app based on aggregate, anonymized usage patterns

Data Storage

Your data is stored locally on your device and on our secure servers powered by Supabase. All data in transit is encrypted using HTTPS. All data at rest on our servers is encrypted using industry-standard encryption. Database access is protected by row-level security policies that scope your data to your account. Your journal entries, reflections, conversations with Marlo, and other personal responses are not sold to advertisers, data brokers, or any other third parties.

Third-Party Services

We use the following third-party services:

  • Supabase — Authentication and secure data storage

  • Superwall — Subscription management and paywall presentation

  • Apple StoreKit — In-app purchase processing

  • Discord — Optional community access (governed by Discord's own privacy policy)

  • Twilio — Delivery of phone calls for recovery alerts

  • Anthropic — AI processing for the Marlo companion feature (operator of the Claude API)

  • Cloudflare — Hosting for the backend service that powers Marlo

We do not share your personal information with advertisers or data brokers.

Subscriptions and Payments

FoodNoise offers auto-renewable subscriptions. Payment is processed through Apple's App Store. We do not collect or store your payment information. Subscription management and cancellation are handled through your Apple ID settings. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

Your Rights

You have the right to:

  • Access the personal data we hold about you

  • Request deletion of your account and all associated data

  • Opt out of notifications at any time through your device settings

  • Export your data upon request

Phone Number and Communications

When you provide your phone number during setup, we use it to place calls as part of the app's recovery features. This includes alert calls when you attempt to open a blocked app during your set danger hours. The call plays back a voice message you recorded during setup. We use Twilio, a third party communications provider, to deliver these calls. Your phone number is shared with Twilio solely for this purpose. We do not sell your phone number or use it for marketing. For further assistance contact support@foodnoise.app.

Face Data (TrueDepth API)

FoodNoise uses the TrueDepth camera and ARKit for the Don't Smile challenge feature. The app detects whether the user is smiling by analyzing facial expressions in real time using Apple's ARKit framework. The app only accesses the mouthSmileLeft and mouthSmileRight blend shape values to determine if the user is smiling. The app does not access facial geometry, depth data, or any identifying facial features. This processing happens entirely on the device. No face data, facial maps, facial feature data, or any biometric information is collected, stored, transmitted, or shared with any third party. Face data is never written to disk, never sent to a server, and never leaves the device. The TrueDepth camera is only active while the Don't Smile challenge is on screen and stops immediately when the user exits. No face data is retained after the session ends. Users can revoke camera access at any time in iOS Settings, Privacy and Security, Camera, FoodNoise.

AI Companion (Marlo) Conversations

When you use Marlo, our AI companion feature within FoodNoise, the following data is processed:

Messages you send to Marlo. Your messages are transmitted over an encrypted connection to our backend service, which is hosted on Cloudflare. Your messages are then forwarded to Anthropic, the operator of the Claude API, which generates Marlo's responses. Anthropic processes API requests solely to generate responses and does not use them to train its underlying AI models. You can review Anthropic's privacy practices at anthropic.com/legal/privacy.

Marlo's responses to you. Responses are generated by Anthropic's AI and returned through our backend.

Onboarding context. A summary of the answers you provided during the FoodNoise onboarding questionnaire — including your self-reported binge frequency, years struggling, goals, symptoms, eating patterns, and similar information — is included as background context with each Marlo conversation so Marlo can respond more usefully. This context is sent to Anthropic alongside your messages and is not shared outside the AI processing pipeline. Sensitive identifiers such as your name, phone number, email address, and account credentials are not included in this context.

Conversation storage. Your messages and Marlo's responses are stored on our servers, hosted by Supabase, to maintain context across sessions and to allow you to scroll back through previous conversations. Storage is encrypted at rest and access is protected by database-level security policies that scope each conversation to the user who created it.

Conversation review by authorized personnel. A small number of authorized FoodNoise personnel may review the contents of Marlo conversations for the following limited purposes: monitoring for users in crisis who may need direct intervention, evaluating and improving Marlo's response quality, and detecting abuse or violations of these Terms. Access is logged. Reviewed conversations are not sold, shared, or published externally.

Crisis recognition. Marlo is configured to recognize signals of self-harm, suicidal ideation, or other acute distress and to surface crisis resources within the conversation, including the 988 Suicide and Crisis Lifeline and the Crisis Text Line. In rare cases involving imminent risk of harm to yourself or others, FoodNoise may take additional steps consistent with applicable law, including contacting emergency services where information is available to do so.

Deleting your conversations. You can delete your entire Marlo conversation history at any time from Settings → Account → Delete Data. Deletion is permanent and removes the data from our servers. Deletion of your account also removes all associated Marlo conversations within 30 days.

Data you choose to share. Conversations with Marlo may contain personal or sensitive information, depending on what you choose to share. You should not submit information that you do not wish to be processed in accordance with this Privacy Policy.

No Protected Health Information

FoodNoise is not a covered entity under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"). FoodNoise does not purposefully collect, store, or process "protected health information" as defined by HIPAA, and the data we collect is not subject to HIPAA's protections.

While conversations with Marlo and journal entries within the app may include information about your health, mental health, medications, or eating patterns that you choose to share, this information is collected and used solely as described in this Privacy Policy and is not treated as protected health information.

You should not submit medical records, clinical notes, identifying information about other individuals, or other protected health information to FoodNoise or to Marlo. By using FoodNoise, you agree not to submit such information and to indemnify and hold us harmless from any claims arising from your submission of such information.

Children's Privacy

FoodNoise is not intended for use by anyone under the age of 16. We do not knowingly collect personal information from individuals under 16. If you are under 16, please do not use FoodNoise or submit any information to us. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at support@foodnoise.app and we will take steps to delete that information from our servers.

Data Retention

We retain your data for as long as your account is active. If you delete your account, we will delete your personal data within 30 days, except where retention is required by law.

Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the updated policy within the app. Your continued use of FoodNoise after changes are posted constitutes acceptance of the updated policy.
