Welcome to FoodNoise. By downloading, accessing, or using the FoodNoise mobile application, you agree to be bound by these Terms of Use. If you do not agree, do not use the app.

About FoodNoise

FoodNoise is a peer support app designed to help people working through binge eating. The app provides tools, community access, daily intentions, journaling, and progress tracking.


Important: FoodNoise is not a medical app and does not provide medical advice, diagnosis, or treatment. The app is not a substitute for professional medical or psychological care. If you are in crisis, please contact a healthcare provider or call 988 (Suicide and Crisis Lifeline).

Eligibility

You must be at least 13 years old to use FoodNoise. By using the app, you represent that you meet this age requirement.

Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating your account.

Subscriptions and Billing

FoodNoise offers auto-renewable subscription plans:

  • Weekly subscription

  • Annual subscription

Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your Apple ID Account Settings. No refunds will be provided for the unused portion of any subscription period.

Acceptable Use

When using FoodNoise and its community features, you agree not to:

  • Share content that promotes disordered eating behaviors

  • Harass, bully, or threaten other users

  • Share other users' personal information without consent

  • Use the app for any unlawful purpose

  • Attempt to access other users' accounts or data

  • Share your community access code with others

We reserve the right to suspend or terminate accounts that violate these terms.

Community

FoodNoise includes access to a private, heavily moderated community hosted on Discord. Community participation is subject to both these Terms and the community guidelines posted within the Discord server.

The community is moderated to maintain a safe, supportive, and recovery-focused environment. Moderation actions include but are not limited to: message deletion, muting, temporary suspension, and permanent removal from the community. Moderators have full discretion over enforcement and moderation decisions are final.

Behaviors that may result in moderation action include:

  • Sharing content that promotes, encourages, or glorifies disordered eating behaviors

  • Harassing, bullying, or threatening other members

  • Sharing graphic or triggering content without appropriate context

  • Soliciting or promoting products, services, or other communities

  • Sharing other members' personal information or stories outside the community

  • Repeatedly violating community guidelines after warnings

Refund Policy

All subscription payments are processed through Apple's App Store and are subject to Apple's refund policies. FoodNoise does not issue refunds directly.

If your community access is restricted due to a moderation action (including muting, suspension, or removal), you are not entitled to a refund for your subscription. Your subscription provides access to the full FoodNoise app, which includes tools, journaling, progress tracking, and other features independent of community access. Community access is a benefit of your subscription, not the sole feature.

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period.

Your Content

You retain ownership of all content you create in the app, including journal entries, reflections, and responses. By using the app, you grant us a limited license to store and process this content solely for the purpose of providing the FoodNoise service to you. We will never share your personal content publicly or with third parties.

Intellectual Property

All content, design, artwork, and code within FoodNoise are owned by FoodNoise and protected by copyright. You may not copy, modify, distribute, or reproduce any part of the app without written permission.

Disclaimer

FoodNoise is provided "as is" without warranties of any kind. We do not guarantee that the app will be uninterrupted, error-free, or that it will meet your specific expectations. Your use of the app is at your own risk.

FoodNoise is a peer support tool, not a licensed healthcare provider. The tools and content in the app are based on evidence-based practices but are delivered in a peer support context. Always consult a qualified professional for medical or psychological concerns.

Limitation of Liability

To the maximum extent permitted by law, FoodNoise shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to loss of data, emotional distress, or interruption of service.

Changes to These Terms

We may update these Terms from time to time. Continued use of the app after changes are posted constitutes acceptance of the updated terms. Material changes will be communicated through the app.

Termination

We may suspend or terminate your access to FoodNoise at any time for violation of these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the app ceases immediately.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
