Welcome to FoodNoise. By downloading, accessing, or using the FoodNoise mobile application, you agree to be bound by these Terms of Use. If you do not agree, do not use the app.

About FoodNoise

FoodNoise is a peer support app designed to help people working through binge eating. The app provides tools, community access, daily intentions, journaling, and progress tracking.


Important: FoodNoise is not a medical app and does not provide medical advice, diagnosis, or treatment. The app is not a substitute for professional medical or psychological care. If you are in crisis, please contact a healthcare provider or call 988 (Suicide and Crisis Lifeline).

Medical Emergencies

FoodNoise is not a treatment for suicidal ideation, depression, trauma, psychiatric problems, eating disorders, or substance abuse. FoodNoise does not provide crisis support, individual counseling, therapy, or medical care. Marlo is an AI-powered peer-style companion and is not a crisis service.

Eligibility

You must be at least 16 years old to use FoodNoise. By using the app, you represent and warrant that you are 16 years of age or older. If you are under 16, you are not permitted to use FoodNoise, agree to these Terms, or submit any information to us.Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating your account.

Subscriptions and Billing

FoodNoise offers auto-renewable subscription plans:

  • Weekly subscription

  • Annual subscription

Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your Apple ID Account Settings. No refunds will be provided for the unused portion of any subscription period.

Phone Calls

FoodNoise may call your phone as part of the app's recovery features if you opt in during setup. This includes calls when you attempt to open a blocked food delivery app during your set danger hours. The call will play back a voice message you recorded during setup. You can disable this feature at any time in the app's blocker settings. By providing your phone number, you consent to receiving these calls. Calls will come from (888) 217-4130. We recommend saving this number as 'FoodNoise' in your contacts so you recognize the call.

AI Companion (Marlo)

FoodNoise includes an AI-powered companion feature called Marlo. Marlo is an automated system designed to provide peer-style support during moments when food thoughts become disruptive, when urges feel overwhelming, or when you simply need someone to talk to.

Marlo is not a licensed therapist, doctor, psychologist, dietitian, counselor, social worker, or any other healthcare or mental health professional. Marlo does not provide medical, clinical, psychological, nutritional, legal, or financial advice. Conversations with Marlo do not constitute therapy, counseling, diagnosis, or treatment of any kind. No clinical, therapeutic, or patient relationship is created through your use of Marlo.

Marlo's responses are generated automatically by artificial intelligence and may be inaccurate, incomplete, outdated, or inappropriate for your situation. You are solely responsible for any decisions, actions, or inactions you take based on Marlo's responses. You should never disregard professional advice, including medical advice, or delay seeking it because of something Marlo has said.

By using Marlo, you acknowledge and agree that:

  • Marlo is provided "AS IS" and "AS AVAILABLE," without warranties of any kind

  • Marlo is intended for general support and informational purposes only

  • You will not use Marlo if you are actively suicidal, in acute medical distress, in detox, or otherwise in need of emergency or hospital care

  • You will not submit unlawful, abusive, harassing, sexually explicit, or harmful content to Marlo

  • You will not attempt to extract, reverse-engineer, jailbreak, or otherwise misuse Marlo or the AI systems that power it

  • You will not use Marlo to impersonate another person, generate content intended to deceive others, or share Marlo's responses publicly in ways that misrepresent the FoodNoise service

  • You are solely responsible for the content you share with Marlo, including any health-related, personal, or sensitive information

Your conversations with Marlo are stored on our servers to maintain context across sessions, and may be reviewed by authorized FoodNoise personnel for safety monitoring, quality assurance, and abuse detection. You can delete your Marlo conversation history at any time in app settings. See our Privacy Policy for full details.

FoodNoise may, through Marlo or elsewhere in the app, suggest third-party services, including telehealth providers, recovery programs, or recovery-related products. We may receive compensation for some referrals. You are solely responsible for any decisions about engaging with third-party services. We do not endorse, screen, or guarantee any third-party service.

We may suspend or terminate access to Marlo at any time, with or without notice, if we believe it is being used in violation of these Terms.

No Protected Health Information

FoodNoise is not a covered entity under HIPAA, and the information you submit to FoodNoise is not protected health information under HIPAA.

You agree not to submit medical records, clinical notes, identifying information about other individuals, or other protected health information to FoodNoise, to Marlo, or through any other feature of the app. You agree to indemnify and hold harmless FoodNoise from any claims, damages, or expenses arising from your submission of such information.


Acceptable Use

When using FoodNoise and its community features, you agree not to:

  • Share content that promotes disordered eating behaviors

  • Harass, bully, or threaten other users

  • Share other users' personal information without consent

  • Use the app for any unlawful purpose

  • Attempt to access other users' accounts or data

  • Share your community access code with others

  • Use Marlo or any AI feature in violation of the AI Companion section above

  • Submit prompts intended to extract, manipulate, or jailbreak the underlying AI systems

  • Generate, request, or attempt to generate content that is unlawful, harmful, sexually explicit, or that depicts violence or self-harm

  • Use FoodNoise or Marlo to make medical, clinical, financial, or legal decisions without consulting a qualified professional

We reserve the right to suspend or terminate accounts that violate these terms.

Community

FoodNoise includes access to a private, heavily moderated community hosted on Discord. Community participation is subject to both these Terms and the community guidelines posted within the Discord server.

The community is moderated to maintain a safe, supportive, and recovery-focused environment. Moderation actions include but are not limited to: message deletion, muting, temporary suspension, and permanent removal from the community. Moderators have full discretion over enforcement and moderation decisions are final.

Behaviors that may result in moderation action include:

  • Sharing content that promotes, encourages, or glorifies disordered eating behaviors

  • Harassing, bullying, or threatening other members

  • Sharing graphic or triggering content without appropriate context

  • Soliciting or promoting products, services, or other communities

  • Sharing other members' personal information or stories outside the community

  • Repeatedly violating community guidelines after warnings

Refund Policy

All subscription payments are processed through Apple's App Store and are subject to Apple's refund policies. FoodNoise does not issue refunds directly.

If your community access is restricted due to a moderation action (including muting, suspension, or removal), you are not entitled to a refund for your subscription. Your subscription provides access to the full FoodNoise app, which includes tools, journaling, progress tracking, and other features independent of community access. Community access is a benefit of your subscription, not the sole feature.

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period.

Your Content

You retain ownership of all content you create in the app, including journal entries, reflections, and responses. By using the app, you grant us a limited license to store and process this content solely for the purpose of providing the FoodNoise service to you. We will never share your personal content publicly or with third parties.

Intellectual Property

All content, design, artwork, and code within FoodNoise are owned by FoodNoise and protected by copyright. You may not copy, modify, distribute, or reproduce any part of the app without written permission.

Disclaimer

FoodNoise, including the Marlo AI companion, is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.

We do not guarantee that the app or Marlo will be uninterrupted, error-free, secure, or that any specific content, response, or feature will meet your expectations or be appropriate for your situation.

FoodNoise is a peer support tool, not a licensed healthcare provider. The tools, content, and AI responses in the app are based on evidence-based approaches to binge eating recovery but are delivered in a peer support context. Always consult a qualified medical or mental health professional for medical, psychological, or other professional concerns.

Marlo's responses are generated by artificial intelligence and may be inaccurate, incomplete, or inappropriate. You assume all risk associated with relying on Marlo's responses. We disclaim all liability for any loss or harm arising from your reliance on information provided by Marlo or any other feature of the app.

We have no control over and no duty to take action regarding which users access the app, what content they encounter, what effect that content has on them, how they interpret it, or what actions they take as a result. You release us from all liability arising from your use of the app and any content within it.

Limitation of Liability

To the maximum extent permitted by law, FoodNoise and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of data, loss of profits, emotional distress, physical harm, interruption of service, or any damages arising from your use of or inability to use the app or Marlo, regardless of the legal theory under which such damages are sought.

In no event shall the total aggregate liability of FoodNoise to you for all claims arising out of or relating to these Terms or your use of the app exceed the amount you have paid to FoodNoise in the twelve (12) months preceding the event giving rise to the claim, or fifty U.S. dollars ($50.00), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless FoodNoise and its officers, employees, agents, and contractors from any claims, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the app or Marlo, (b) your violation of these Terms, (c) your violation of any law or the rights of any third party, (d) any content you submit to the app or to Marlo, or (e) your submission of protected health information or information about other individuals to the app.

Changes to These Terms

We may update these Terms from time to time. Continued use of the app after changes are posted constitutes acceptance of the updated terms. Material changes will be communicated through the app.

Termination

We may suspend or terminate your access to FoodNoise at any time for violation of these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the app ceases immediately.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
